Abstract

Judicial reform was an important aspect of democratitazion in Indonesia. There is still a lack of study about the change of judicial role in relation to the regime form. The paper will discuss the role of judicial politics in the era of Presidents Sukarno, Suharto, Habibie, Wahid, Megawati and Yudhoyono. The conclusion will show that judicial politics depend on the repressive behavior of the regime. The more rigid judicial politics are the more repressive of the regime. Therefore judicial reform belongs to the most challenging theme in the transition to democracy.
