The Repression of Transnational Crime Character between New Common Challenges and Transfer of Sovereignty in Criminal Matters

Abstract

The transnational crime is one of the most serious problems that the EU has to face. In particular, some of the economic and legal aspects of interaction between states have highlighted how much corruption and organized crime are diffused situations and able to endanger the development of the EU. We could see one example of this situation in the field of public procurement where the internal regulations of the EU have evidenced their inadequacy in preparing effective measures for the repression of crime. Therefore,nowadays the challenge is to develop within the EU common legal instruments which have to be able to overcome the shortcomings of national systems and to bring the level of European integration at the following step. At this point we should know: are member States really ready to give up part of their sovereignty in criminal matters? Has article 83 TFEU really marked a turning point?
