Abstract

The objective of this study is to analyze the existence of a conflicting dichotomy of principals within the anticorruption regime. Currently, several international organizations, regional or global, have established conventions and recommendations regarding this issue-area, but, even so, there seems to be failed attempts to broaden the scope of what to regulate as corruption. This study’s hypothesis is: there are two principles coexisting conflictingly within the regime that influence the norms, rules and decision-making procedures and hinder development of mechanisms that fight corruption at all levels (including private-private), the narrower anti-bribery principal and the broader anticorruption principle. Therefore, the interests behind the construction of the regime shall be analyzed, as well as the structures of the OCDE and UN conventions (the first representing the anti-bribery principle and the latter the anticorruption principle) to verify which has stronger enforcement and acceptance among the international system.
