Abstract

The introduction of lobbying regulation is being nowadays considered or even realized in several European countries. There are some empirical studies of the current state of framing relations and contacts between lobbyists and public office holders, especially published by OECD, but besides the mainstream interpretation of lobbying regulation as the adoption of lobbying act and establishment of lobbyists’ register, we underline more broad and complex approach. Our objective here is to draw attention to the variety of regulatory means and options which can be chosen. We do not, however, intend to present detailed mapping of lobbying regulation in all possible arenas or evaluate these means or even recommend particular regulatory options and instruments. The purpose of this paper is to provide systematic enumeration of all possible alternatives. Our research rests on the examination of most remarkable and significant cases of lobbying regulation in the western world and is based largely on the textual analysis of relevant regulatory documents. We therefore suggest analytical framework highlighting three important points that should be clarified in each regulatory system: 1) the actors of lobbying (Who is to be regulated?), 2) the form of regulation (How to regulate lobbying?) and 3) the regulatory means and instruments (What options and instruments to use?). Proposed topography of lobbying regulation can serve as a general base for further analysis of regulatory mechanisms and their comparison, but also as a guide for those considering regulatory options.
