Argentina's quest to make care a human right

Abstract

In March 2023, Argentina presented a petition before the Inter-American Court of Human Rights, asking the court to issue an advisory opinion on care as a human right and its relation to other rights. Argentina proposed three aspects of the human right to care: to give care, to receive care, and to have self care. Civil society groups throughout Latin American then filed friends of the court briefs, in support of Argentina's petition. This intervention highlights commonalities in how the Argentine government and its allies have constructed the argument for care as a human right and evaluates the implications of these arguments for governments' care policies and efforts to advance gender equality policies through a feminist framing of care.
