Abstract

What makes a rule a good rule? As alternatives to rigid command-and-control regulation, regulators have adopted approaches to address ever-evolving and increasingly complex regulatory contexts. This panel explores a variety of approaches to rule and regulation design and implementation, such as broader and more encompassing rules, making flexibility a key component of regulation and enforcement, and increased reliance on regulatory impact assessments. The contributions examine the practical and normative implications of these approaches, as well as the factors that impact the quality of regulatory design.
