The Overseas Countries and Territories of the EU - Colonial Past, What Future?

Abstract

Law and policy in the overseas countries and territories (OCTs) of the EU is an under-researched topic and yet, as small as they might be, the OCTs raise some really big queries and challenges for the EU; development, the territorial and extraterritorial application of law and policies (eg human rights, crime and security), partnership working and policy-learning and the specificities of EU citizenship in the OCTs are just a few of the topics that have caught the attention of scholars across Europe in recent months and which will hopefully be explored in greater detail in this panel. Interestingly, with the entry into force of the Lisbon Treaty, the focus upon coherence between the different Union policies has increased considerably, as reflected in Arts 21(3)(2) and TEU, 7 TFEU as well as Art 208(1) TFEU. The Lisbon Treaty has also introduced, as a general obligation, that the European Union shall further so-called European values beyond its borders, cf. Arts 3(5) TEU and 21(1) TEU (the so-called 'missionary principle'. ) The panel seeks to generally reflect on what will be the likely impacts of this these changes on EU policy vis-à-vis OCTs? and what problems are likely to arise from these presumed effects? .
