The Judicial Role of Transitional Justice in the Protection of Human Rights

Abstract

The ?explosion? (Alter) of international judiciary by the establishment of international courts and tribunals since 1982 and the permanent rise of workload of the existing courts marks a new era to protect human rights and to guarantee democracy and rule of law. This ?conceptual shift from two legal systems ? international and domestic ? to one? (Slaughter) challenge the traditional comprehension of sovereignty and offers new modes for democratisation and transitional justice. The aim of the panel is to deepen and to systematise the judicial role of transitional justice in the protection of human rights. We invite papers on this general problematique, and in particular on questions about the establishment of human rights and criminal courts, the election of the judges, grade of politicisation and the effectiveness of the decisions, subsidiarity and adaption in domestic courts and law.
