Comprehension of State Capture, Prevention of Organised Crime and the Role of Integrity


Abstract

The proposed paper analyzes and discusses: 1. the changes within organized and white collar crime, as well as corruption; 2. the development of their influence on legislative process; 3. ideas and role of prevention and 4. the role of integrity as crucial segment that (dis)enables organised crime, white collar crime and best of all state capture. Specially vulnerable to state captures are young democracies that often in heist of transitions simply “copy – paste” specifics laws or, the development of the law in interest simply did not receive enough attention of the proper experts. Elites with their financial capital (including organized crime), can be at home with “transition chaos” and quickly seize the opportunity to influence the law making process. The role of proper prevention is their for crucial. Because of the intensive linkage between organized crime, white collar crime and corruption, one preventive measure upon one of the listed criminalities indirectly influences the other. And as implementing prevention needs proper legislatives support, we found ourselves in a problematic loophole, where state capture hardens the development and implementation of proper preventive and reactive legislation and proper legislation and prevention is needed to stop the further development of state capture. Role of integrity here becomes crucial as is the only factor that stays in the way that subjects from organised crime associations, or subjects that are trying to carry out the white collar criminal act or act of corruption, can influence the decision / law / policy maker. The proposed paper their for trays to spread the knowledge about proper preventive measures and trying to develop the idea of integrity profiling or integrity testing as it seams, that even though integrity is recognised in every field of legislation and prevention making, it’s a sort of abstract conception, for which we know what it is, know we need it, but we have no way of knowing if the policy makers, law makers and the ones who later implement and carry out the laws and prevention, poses it.
